News: On March 17, 2011, AeroVironment, Inc. (AV), was informed by the World Intellectual Property Office (WIPO) that AV's Nano Hummingbird is now included in their Gallery of Notable Inventions.  The Nano Hummingbird joins the other 28 inventions of this Gallery; inventions that include an HIV Vaccine, Google, Segway and SpaceShipOne. As noted on their website, the criteria used by WIPO to select an invention for the Gallery is:

the “importance or contribution of the invention or inventor,” and

the “acknowledgment ... [of the invention] ... in the popular media.”

Who we are:

Dr. Michael Blaine Brooks is one of the few patent attorneys you may meet who holds a PhD in engineering from the University of California, Los Angeles ( UCLA ), is a Registered Professional Electrical Engineer in the state of California, a Senior Member of both the Institute of Electrical and Electronics Engineers ( IEEE ) and American Institute of Aeronautics and Astronautics ( AIAA ), and has led the in-house legal and R&D departments of a very high-tech company for several years. This company was based in San Diego with its scientists and engineers principally located in Los Angeles. While Dr. Brooks headed its intellectual property portfolio development in 1998-1999, this company became one of America's fastest growing, privately-held, high-technology corporations. Dr. Brooks was Adjunct Professor of Patent Law, Spring 2011 and Spring 2010, Pepperdine University School of Law. Dr. Michael Blaine Brooks established the present law firm over ten years ago in Calabasas, California, to provide the Greater Los Angeles region and most of Southern California with intellectual property services, particularly patent application drafting and prosecution services, seasoned by his technical, business and legal experiences gained in fast-paced, commercially exploitable and budget-directed high-tech innovations.

Jim K. Dawson, Esq., has been practicing intellectual property law for more than 15 years.  He has extensive experience drafting U.S. and international patent applications (“ PCT ” applications), Office Action responses, responses to Written Opinions and in providing guidance to foreign patent prosecution counsel.  He also performs US patent infringement and validity analysis; drafts and negotiates intellectual property licenses, and complex IP-related legal documents including: technology and product development agreements, service and consulting agreements, trademark licenses, non-disclosure agreements, and other agreements necessary to bring ideas successfully to market. Mr. Dawson holds his Juris Doctor from University of Dayton School of Law, Dayton, Ohio, as part of their Program in Law and Technology.  He is admitted to practice before the U.S. Patent and Trademark Office and the U.S. District Court for the Central District of California

Karol Pessin, Esq., heads our Life Sciences Department spanning innovations in biotechnology, nanotechnology, pharmacological products, medical devices, and methods of medical treatment. Ms. Pessin received her Juris Doctor from University of California Berkeley's Boalt Hall. Her twenty-three years of legal experience includes trade secret litigation and patent prosecution practice at Lyon & Lyon, and her experience includes in-house practice at Amgen Inc. of Thousand Oaks, California, where her scope involved matters at the European Patent Office. In addition to being a skilled patent prosecutor, Ms. Pessin is adept at evaluating patent portfolios of our clients and/or their competitors, and integrating patent strategy into her client’s business strategy.

Pejman Yedidsion, Esq. , supports our clients in various technologies, some of which include electrical, electronic, and/or computing systems and processes. Mr. Yedidsion has extensive experience in telecommunication technologies, and received his Bachelor of Science in Computer Science from the University of California, Los Angeles ( UCLA ), and his Juris Doctor from the University of West Los Angeles School of Law.

NOTICE: US Supreme Court, June 28, 2010: The US Court of Appeals for the Federal Circuit's sole test for patent eligibility of a process, i.e., the machine-or-transformation test, was reduced by the US Supreme Court in Bilski v. Kappos from the sole test to an evaluative tool for determining patent eligibility. The Opinion immediately affects business methods and patents implemented via software. Before claims that are directed to a method or a process can be examined for novelty and non-obviousness, each claim must be directed to more than merely an abstract idea, law of nature, or mathematical formula. Patent practitioners and patent applicants are encouraged to review the opinion of the US Supreme Court.  In defining a patent-eligible process, the Court cited 35 USC §100(b) and the Court's "guidepost" opinions of Benson, Flook, and Diehr. The USPTO interim patent subject matter eligibility examination instructions issued on August 24, 2009 were superseded by the interim guidance published for comment on July 27, 2010.

PATENTS & TRADEMARKS: The bulk of the services provided by the Firm pertain to the preparation and prosecution of trademarks and complex patent applications for electrical, optical, mechanical, electro-mechanical, electronic, computer-based, network-based, and software-related inventions before the US Patent and Trademark Office. In collaboration with foreign patent attorneys and agents, the Firm prosecutes foreign patent applications and trademark registrations often via the Patent Cooperation Treaty ( PCT ) and, for trademarks, via the Madrid Protocol. *Although KIPO is not obliged to search claims directed to methods of treatment (by surgery or therapy) tied to the human body, and is not obliged to search claims directed to diagnostic methods practiced on the human body.
